Trump Requests Top Court Clearance for National Guard Forces in the State of Illinois
On Friday, the administration submitted an urgent appeal to the US supreme court, asking for approval to deploy national guard troops to Illinois.
This move is part of a wider push to expand the internal deployment of the troops in several cities run by Democrats.
Legal Battle Over Troop Deployment
In an urgent petition, the federal legal authorities asked the bench to set aside a earlier court order that had halted the sending of hundreds of state guard personnel to the Chicago region.
The district judge had raised doubts about the government's explanation for sending troops, questioning its reasoning in light of the situation on the ground.
A higher court upheld the previous order on Thursday, keeping the deployment on pause while the judicial dispute proceeds.
White House's Arguments
The top government lawyer, representing the White House, wrote in the new filing that federal law enforcement have frequently been “threatened and assaulted” in Chicago and the outlying area of Broadview community.
This location is home to an ICE detention center.
The former president has previously deployed military reserve forces to the Windy City and Portland, following earlier sendings to Los Angeles, California, the city of Memphis, and Washington DC.
The White House has argued that armed forces involvement is needed to control demonstrations and support immigration enforcement.
Political Opposition
Democratic officials have pushed back sharply the move, claiming that the White House's statements are greatly exaggerated and partisan in nature.
They allege the administration of exploiting his authority to retaliate against critics.
The judiciary have also expressed doubt about the White House's description of the situation.
Regional authorities claim that demonstrations over immigration enforcement have been primarily small and peaceful, contradicting the former president's portrayal of “combat area” situations.
Statutory Grounds
At the heart of the legal battle is the administration's application of a national law authorizing the executive branch to take control of the military reserve only in situations of insurrection or when “powerless with the standard military to carry out the regulations of the nation”.
The White House insists that the forces are required to safeguard federal property and agents from activists.

Earlier this month, the administration nationalized three hundred troops of the state guard of Illinois and ordered more Texas national guard troops into the state.
As local leaders criticized the decision, the president increased his statements, urging the apprehension of the city's leader and the governor of Illinois, each a Democrat, alleging them of not managing to protect federal agents.
The state of Illinois and the city of Chicago jointly sued the White House to halt the sending.
On 9 October, district Judge April Perry, nominated by President Biden, delivered a preliminary order blocking the order.

At the same time in the city, at least 11 people were arrested outside the federal detention center following intense clashes between local police and activists.
